1. Introduction
These Terms of Service govern your use of unid.lk and the professional services provided by UNID.Digital, operated by Dhanushka, a freelance web developer based in Kandy, Sri Lanka.
By engaging my services or using this website, you agree to be bound by these terms. If you do not agree, please do not use this site or engage my services.
2. Services Provided
UNID.Digital offers the following services:
- Website design and development
- Search engine optimisation (SEO)
- Answer engine optimisation (AEO)
- Domain registration and web hosting
- E-commerce development
- Brand naming and identity
- Website maintenance and support
All services are delivered personally by me and are not outsourced to third parties unless explicitly agreed with the client.
3. Project Engagements
Quotations and Agreements
All project work begins with a written quotation or proposal. Commencement of work is subject to the client's written (email or message) confirmation and, where applicable, an initial deposit.
Timelines
Estimated timelines are provided in good faith and may be affected by the timely provision of content, feedback, and materials by the client. Delays caused by the client do not constitute a breach of agreement on my part.
Revisions
Each project includes a defined number of revision rounds as stated in the project proposal. Additional revisions beyond the agreed scope may be charged separately.
4. Payments
- Projects typically require a deposit before work commences, as agreed in the proposal
- The remaining balance is due upon project completion and before final delivery or go-live
- Recurring services (hosting, maintenance plans) are billed monthly or annually as agreed
- Late payments may result in suspension of hosting or support services
Payment methods accepted include bank transfer and other methods agreed at the time of engagement.
5. Intellectual Property
Upon full payment, all custom website design and code developed specifically for your project becomes your property. I retain the right to display the work in my portfolio unless you explicitly request otherwise.
Third-party assets (fonts, stock images, plugins, frameworks) remain subject to their respective licences and are not transferred as part of the project ownership.
6. Hosting Services
Web hosting services are provided on a shared or managed server environment using Plesk Panel. I reserve the right to:
- Perform routine maintenance (with advance notice where possible)
- Suspend accounts that violate acceptable use policies
- Terminate hosting for non-payment after a grace period
Hosting fees are non-refundable once a billing period has commenced. Backups are provided as a courtesy and are not guaranteed; clients are encouraged to maintain their own backups.
7. Limitation of Liability
To the maximum extent permitted by law, UNID.Digital shall not be liable for any indirect, incidental, or consequential damages arising from the use of services or the website, including but not limited to loss of data, revenue, or business opportunities.
My total liability for any claim shall not exceed the total amount paid for the specific service giving rise to the claim.
8. Client Responsibilities
As a client, you agree to:
- Provide accurate content, assets, and information required for the project
- Respond to queries and requests for feedback within a reasonable timeframe
- Ensure that any materials provided do not infringe third-party rights
- Not use any website or service delivered by me for unlawful purposes
9. Termination
Either party may terminate an ongoing engagement with written notice. In the event of termination:
- Work completed to date will be invoiced at the agreed rate or pro-rated amount
- Deposits are non-refundable unless work has not yet commenced
- All deliverables completed and paid for will be handed over
10. Governing Law
These Terms of Service are governed by the laws of Sri Lanka. Any disputes shall be resolved through mutual agreement in the first instance, and thereafter through the appropriate legal jurisdiction in Sri Lanka.
11. Changes to These Terms
I may update these Terms of Service from time to time. Continued use of the website or services after changes are posted constitutes your acceptance of the revised terms.
